David H. Bernstein is a partner with Debevoise & Plimpton LLP in New York, where he practices in the firm's Intellectual Property Litigation Practice Group and its International Dispute Resolution Practice Group. He focuses on a wide range of intellectual property and unfair competition matters including trademark and trade dress infringement and dilution, false advertising law, and Internet and domain name law. Mr. Bernstein also is an active arbitrator, including with the World Intellectual Property Organization ("WIPO") Arbitration and Mediation Center, the National Arbitration Forum, the London Court of International Arbitration, and the Hong Kong International Arbitration Centre.
Mr. Bernstein is regularly ranked as one of the nation's leading trademark litigators. He has been awarded the Burton Award for Legal Achievement and the International Trademark Association ("INTA") Volunteer Service Award for the Advancement of Trademark Law. In 2011, Managing Intellectual Property Magazine selected Mr. Bernstein as the Outstanding IP Practitioner of the Year.
Mr. Bernstein is a past counsel and director of INTA, and currently chairs INTA's U.S. Amicus Brief Subcommittee. Mr. Bernstein is also a frequent writer: He is co-author of the treatise The Law of Advertising, Marketing and Promotion, of the chapter on trademark and unfair competition law in the treatise Internet and Online Law, of the chapter on advertising law in the treatise Successful Partnering Between Inside and Outside Counsel, and of several law review articles including No Trolls Barred: Trademark Injunctions After eBay, 99 The Trademark Reporter 1037 (2009); Ethics and Privilege in United States Trademark Practice, 93 The Trademark Reporter 1240 (2003); and As Satiric as They Wanna Be: Parody Lawsuits Under Copyright, Trademark, Dilution and Publicity Laws, 85 The Trademark Reporter 239 (1995).
In addition to teaching at The George Washington University Law School, Mr. Bernstein is an adjunct professor of law at New York University Law School and he teaches the annual Advanced Workshop on Domain Name Dispute Resolution at WIPO. Prior to his career at Debevoise, Mr. Bernstein clerked for the Honorable Robert E. Keeton of the District of Massachusetts.
