Judge Smith began practice with the U.S. Army Judge Advocate General's Corps in 1978. He was on active duty for almost eight years, serving in the United States and Germany. From 1987 to 1990, Judge Smith practiced as the Senior Assistant Public Defender in Fairfax County, Virginia.
In October 1990, the General Assembly of Virginia elected Judge Smith to the General District Court of Fairfax County. He served on that bench until February 2008 when the General Assembly elected him to the Circuit Court of Fairfax County where he currently serves.
Judge Smith continued his practice with the United States Army Reserve, retiring after 30 years of service in September 2009. He finished his Army career serving for two years as the Chief Trial Judge of the Army Reserve.
