The NDAA for Fiscal Year 2012, like its predecessors, includes important provisions affecting the rights of the government and industry in technical data used in defense contracts. Among other provisions, Section 815 of the new NDAA addresses how independent research and development costs are to be treated; permits the release of contractors’ technical data to people outside the government in certain circumstances; and gives the government six years to challenge use or release restrictions asserted by a contractor.
