Andrew Dhuey specializes in intellectual property litigation, usually before appellate courts. He is authorized to practice before the Supreme Court of the United States, all thirteen Circuits of the U.S. Courts of Appeals, the U.S. Court of International Trade, and all state and federal courts in California.
Mr. Dhuey is a 1989 graduate of the University of Wisconsin, Madison, School of Business and a 1992 graduate of the University of California, Hastings College of Law. He began his legal practice as a patent litigator in the San Francisco office of Pillsbury Madison & Sutro, now known as Pillsbury Winthrop Shaw Pittman. He was named "Appellate Lawyer of the Week” by the National Law Journal on Aug. 5, 2010. On July 24, 2017, he was featured in a profile on law.com entitled "Small Practices, Big Impacts: Meet the Lawyers Behind Two Major-League IP Cases.”
Although Mr. Dhuey has served as lead counsel in a wide variety of patent, copyright, trademark and trade secret cases, his representation of nature photographer David Slater in the "Monkey Selfie” case (Naruto v. Slater) is his primary claim to fame. People for the Ethical Treatment of Animals brought a copyright infringement case, purportedly on behalf of an Indonesian crested macaque who took a selfie photo with Mr. Slater’s camera. The case attracted widespread, international media attention. Mr. Dhuey won dismissal of the case at the district court (N.D. Cal.), affirmance at the Court of Appeals (9th Cir.) and an award of attorney fees against PETA. See 888 F.3d 418. His two-page district court brief ("Monkey see, monkey sue is not good law”) is reprinted and presented as exemplary legal writing in the Aspen Handbook for Legal Writers.
