This year's recipient of the Eisenberg Prize is Professor Charles Tyler, for "The Adjunctive Model of Precedent," University of Chicago Law Review, September 2020. In this article, Professor Tyler offers the adjudicative model's first empirical and normative assessment. It describes an empirical case study of the Ninth Circuit and finds that, after adopting the adjudicative model, that court was more likely to follow its precedent in cases involving disputes about the holding/dictum distinction.

"It was a tremendous honor to receive an award from the nation's foremost organization of appellate attorneys. I am especially humbled to be in the company of past winners," said Professor Tyler.

The American Academy of Appellate Lawyers (AAAL) created the Eisenberg Prize to recognize the publication of high-quality articles in the field of appellate practice and procedure. The award is named in honor of the late Howard B. Eisenberg, Dean of the Marquette University Law School and an early AAAL member.
