Obamacare's Grave Danger

Two federal courts of appeals have issued conflicting rulings on a critical provision within the health care law, the more favorable of which enables the IRS to interpret ambiguous statutory language. Under President Obama, the IRS' interpretation allows the Affordable Care Act to function, but as Professor Siegel explains, “The next president, by simple executive action, without need for congressional approval, could potentially undo this critical piece of the Affordable Care Act's statutory scheme.”
